Hydra NY, Inc., and its subsidiaries and affiliates operating under the Hydra Studios brand (“Hydra Studios”, “we” or “us”) operates the website located at https://www.hydranewyork.com, and related websites and desktop, mobile and other applications (the “Website”).

We respect the privacy of our users and are committed to protecting it through our compliance with this privacy policy. This privacy policy describes the types of information we may collect from you or that you may provide when you access or use the Website, the Hydra Studios in-studio locations, or any of our other products or services (collectively, the “Services”) and our practices for collecting, using, maintaining, protecting and disclosing that information.

This privacy policy applies to information we collect (i) on or through your use of the Services; (ii) in email and other electronic messages between you and Hydra Studios; and (iii) through any mobile and desktop applications you use in connection with the Services.

This privacy policy does not apply to information you provide to or is collected by any third party whether through or in connection with your use of the Services or otherwise, including through any third party application or content (including advertising) that may link to or be accessible from or on the Services. You agree and acknowledge that Hydra Studios has no duty or responsibility to maintain and safeguard any information you may provide to, or is collected by, any third party whether through or in connection with your use of the Services or otherwise.

Children Under the Age of 13

Information We Collect About You

We collect several types of information from and about users of the Services, some of which is personally identifiable and some of which is non-identifying or aggregated, including information:

We collect information from you when you contact us, register with our Website, sign up for a membership, reserve classes or sessions, make a purchase, or otherwise interact with our Website or our studio staff.

The information we collect on or through the Website or otherwise through your use of the Services varies based on your interaction with us and may include (i) information that you provide about yourself or others by using the Services, including information provided at the time of registering to use the Services (such as name, password, and email address), by posting material or by requesting further Services; (ii) records and copies of your correspondence (including email addresses), if you contact us; (iii) your responses to surveys that we might ask you to complete for research purposes; and (iv) details of any transactions you carry out through the Services, including information provided at the time of purchase or attempted purchase (such as name, password, email address, mailing address, shipping information, and payment information).

Information Collected Through Data Tracking Technologies 

As you use the Services, we may use automatic data collection technologies to collect certain information about your devices, browsing actions and patterns, including details of your use of the Services (such as traffic data, location data, logs and other communication data) and information about your devices and internet connection (including your IP address, operating system and browser type).

How We Use Your Information

Disclosure of Your Information

We may disclose anonymized, de-identified or aggregated information about our users, and information that does not identify any individual, without restriction.

We may disclose personal information that we collect or you provide:

  • To contractors, service providers and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.

Any aggregated information shared this way will not contain any personal information.

Hydra Studios disclaims all liability for the disclosure of information (including health information) that you choose to submit voluntarily. You assume all such risks with regards to your use of the Services.  

Your Choices About Our Use and Disclosure of Your Information

We strive to provide you with choices regarding the personal information you provide to us. This section describes mechanisms we provide for you to control certain uses and disclosures of your information.

    • Tracking Technologies. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies or block the use of other tracking technologies, some parts of the Services may then be inaccessible or not function properly.
    • Third-Party Advertising. If you do not want us to share your personal information with unaffiliated or non-agent third parties for advertising and marketing purposes as provided herein, you can opt-out by logging into the Services and adjusting your user preferences in your account profile or by sending us an email stating your request to team@hydranewyork.com.
    • Location Information. You can choose whether or not to allow the Services to collect and use real-time information about your device’s location through the device’s privacy settings. If you block the use of location information, some parts of the Services may then be inaccessible or not function properly.
    • Promotional Offers. If you do not want us to use your email address or contact information to promote our own or third parties’ products or services as provided herein, you can opt-out by logging into the Services and adjusting your user preferences in your account profile or by sending us an email stating your request to team@hydranewyork.com.
  • Targeted Advertising. If you do not want us to use information that we collect or that you provide to us to deliver advertisements according to our advertisers’ target-audience preferences as provided herein, you can opt-out by logging into the Services and adjusting your user preferences in your account profile or by sending us an email stating your request to team@hydranewyork.com.
  • Users in the United States may opt out of many ad networks, including those we may work with on our Website. For example, you may go to the Digital Advertising Alliance (“DAA”) Consumer Choice Page (http://www.aboutads.info/choices/) for information about opting out of interest-based advertising and their choices regarding having information used by DAA companies. You may also go to the Network Advertising Initiative (“NAI”) Consumer Opt-Out Page (http://www.networkadvertising.org/choices/) for information about opting out of interest-based advertising and their choices regarding having information used by NAI members

    Opting out from one or more companies listed on the DAA Consumer Choice Page or the NAI Consumer Opt-Out Page will opt you out from those companies’ delivery of interest-based content or ads to you, but it does not mean you will no longer receive any advertising through our Website or on other websites. You may continue to receive advertisements, for example, based on the particular website that you are viewing (i.e., contextually based ads). Also, if your browsers are configured to reject cookies when you opt out on the DAA or NAI websites, your opt out may not be effective.     Hydra Studios has processes in place that are designed to recognize web browser “do-not-track” signals. The Help portion of the toolbar on most browsers will tell you how to use your web browser’s do-not-track feature. Please be advised that we cannot guarantee that our processes will capture all such do-not-track signals.

    If you are a European resident, you may have the right to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. If you would like to exercise this right, please contact us at team@hydranewyork.com. Additionally, if you are a European resident, we note that we are processing your information in order to fulfill contracts we might have with you (for example if you make an order through the Website), or otherwise to pursue our legitimate business interests listed above, and that your information will be transferred outside of Europe, including to the United States.

    Accessing and Correcting Your Information

    You may review and update your account information by logging into your account and visiting your account profile or settings page. You may also send us an email at team@hydranewyork.com to request access to, correct or delete any personal information that you have provided to us. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

    California Privacy Rights

    The California Consumer Privacy Act of 2018 (“CCPA”) provides additional rights to know, delete and opt out, and requires businesses collecting or disclosing personal information to provide notices and means to exercise rights. Your rights under the CCPA may include the right to delete the personal information we have collected from you; the right know certain information about our data practices; the right to opt-out of the sale of your personal information by us to third parties; and the right not to receive discriminatory treatment by us for the exercise of any of your rights.

    Data Security

    We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration and disclosure. All information you provide to us is stored on our secure servers behind firewalls. Any information you provide to us through your use of the Services will be encrypted using industry standard technology. We cannot, however, ensure or warrant the security of any information you transmit to Hydra Studios or guarantee that your information on the Services may not be accessed, disclosed, altered, or destroyed by a breach of any of our physical, managerial, or technical safeguards.

    The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to the Services, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

    Unfortunately, the transmission of information via the internet is not completely secure.  Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted through the Services. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures we provide.

    Changes to Our Privacy Policy

    Any changes we make to our privacy policy will be posted on this page. If we make material changes to how we treat our users’ personal information, we will notify you through a notice on the Website and/or by any other reasonable means. The date the privacy policy was last modified is identified at the top of the page.     Privacy Notice relating to COVID-19

    In an effort to keep our Hydra Studios community safe in light of the COVID-19 pandemic, we are collecting additional information from our members, guests, employees, and other studio visitors. Our transparency is key to maintaining your trust, and during these unprecedented times, we are especially mindful of striking the right balance between ensuring the health and safety of our members, guests, employees and the public and respecting your privacy. Accordingly, effective as of December 1, 2020, the following privacy notice (the “Privacy Notice”) shall apply in addition to our existing Privacy Policy, which will continue to otherwise govern our collection, use and other processing of your information.

    As the current circumstances and the needs of our community evolve, this Privacy Notice may be modified or updated in our sole discretion. If we make any changes to our Privacy Notice, we will post the revised document here and such changes will be effective immediately upon that posting. Please review this Privacy Notice periodically to ensure you are aware of any changes. 

    What Information We’re Collecting: We may collect certain information about your potential exposure to COVID-19 and health through periodic health declarations we ask you to complete. We may also collect measurements of your body temperature when you are at a studio. We will not record or store your body temperature measurement, but if your body temperature registers higher than our permitted threshold for studio access, we reserve the right to record and indicate in our system that you were denied entrance and are not eligible to return for 3 days. In addition, we may collect information provided by you, or a public health authority or other government agency, if you test positive for COVID-19, including information about how you interacted with Hydra Studios during the time in which you may have been infected with COVID-19. All of the foregoing is referred to in this Privacy Notice as “Screening Information”.   

    What We’re Doing with Screening Information: We collect and use Screening Information to help provide a safe environment for our members, guests, employees, and other studio visitors and to administer your access to our studios. We will use Screening Information in furtherance of those legitimate interests and business purposes. We will not use your Screening Information for any marketing or promotional purposes. 

    How We May Share Screening Information: While we generally will not share your Screening Information without your consent, we reserve the right to disclose this information, and other related information, to government and regulatory authorities, such as the Centers for Disease Control and Prevention and state and local health authorities, or as otherwise necessary or appropriate in furtherance of public health or safety. If we are notified that you tested positive for COVID-19 within 14 days after your last visit to a Hydra Studios location, or if we otherwise determine that you may pose a risk to our community, we reserve the right to disclose to our members, guests, employees, and other studio visitors that an individual who tested positive, or otherwise poses a risk to our community, was in our facilities and while we will not disclose your name unless legally required to do so, we may disclose information such as the date and time of your visit, your gender, and studio areas you used. We share this information to help ensure our studios remain safe for our employees and other members and guests. We may also share your Screening Information and other related information with service providers, advisors or consultants who are performing services on our behalf and for other reasons in accordance with applicable law, as further described in the “How We Use Your Information” section of our Privacy Policy. Please note we may disclose aggregated, de-identified information for any other lawful purpose.  

    How We Retain Screening Information:  Your Screening Information will be protected as described in our Privacy Policy, and will be retained only as long as we determine reasonably necessary to ensure the health and safety for our members, guests, employees, other studio visitors and in accordance with applicable law. As noted above, your body temperature measurement will not be stored unless required by applicable law, but we will retain your acknowledgements of the health declaration, as well as any records (if any) that you were denied entrance and not permitted to return for 3 days. Any information that we retain will be stored for a reasonable period of time, including as we determine necessary to comply with applicable law or to establish or defend our legal rights.   

    Your Options: At this time, Hydra Studios requires you to provide Screening Information as a condition of entry to its studios. However, if you are uncomfortable with providing any requested Screening Information or do not wish to consent to this Privacy Notice, we will refund your class or session purchase.
